 2. FORMATION OF CONTRACT

2.1 When you place an order online this constitutes your offer to purchase one or more products on the website. We will email you to acknowledge receipt of your offer. The contract is not formed at this point.  When we email you with despatch details, this is our acceptance of the offer and the contract is formed.

2.2 The contract relates to items that have been despatched only. The contract does not apply to items in the original order that were not in stock.

2.3 If we are unable to accept your order, due to items being out of stock or similar then we will inform you of this by email.

2.4 By entering into a contract with us on the website, you confirm that you are both legally capable of entering into a contract and over 18 years of age.

4.1 We endeavor to show images on our website as accurately as possible, but they will vary due to color variation on screens. The handmade nature of some of the products can also cause sizes and weights to vary.

5. DELIVERY

5.1 Delivery is free except for delivery to certain areas that attract a premium delivery charge such as the Highlands of Scotland. A list of the affected areas is included on our Delivery page.

5.2 If an item is in stock when your order is placed, delivery is normally 3-5 working days. Items of furniture may be on a longer delivery timescale, and this will be advised at order confirmation. If the items are out of stock when your order is placed, you will be advised of a lead time.

5.3 It is your responsibility to ensure that the products ordered will fit into your property and you should measure doors and room and corridor pinch points to ensure that the products will fit. Should a product not fit, you are entitled to return within 14 days by our returns procedure at your cost.

5.4 Delivery will be made to the address specified when placing the order. The person signing for a delivery must be an adult.

5.5 Goods should be examined carefully on delivery and any defects noted on the delivery driver’s paperwork (if applicable). Any defects should be reported to KC At Home within 48 hours of delivery.  KC At Home will arrange the collection and replacement of the defective item.

5.6 If a delivery timeslot has been agreed for your delivery, and you need to cancel or re-schedule your delivery then you need to inform us the day before the delivery date. If you inform us after this time, we reserve the right to charge a rearranged delivery charge.

5.7 We are not liable for any issues for damage to the product or premises past the threshold of your property or the point at which the product is signed as delivered unless you have paid an additional fee for a 2-man delivery to a ground floor room of your choice. Delivery will not be made up any flights of stairs.

5.8 We will not be held liable for any delivery delays. We will contact you as soon as we are made aware of any delay. You have a right to cancel the contract if you are not content with any revised delivery date.

 6. PRICING AND PAYMENT

 6.1 Please see our website for current payment methods.

6.2 If you pay for goods by credit or debit card your card will be authorised for the price of the goods.

6.3 Due to the large number of products on the website, it is possible that a pricing error might occur. If an error has occurred, we will notify you before despatch, or reject the order and notify you of this.

6.4 If the pricing error is obvious and unmistakable and could reasonably have been recognised by you as mispricing, we may end the contract, even after the despatch email has been sent.

 7. RISK & TITLE

 7.1 The products will be at your risk or loss from the time of delivery. At the point of delivery ownership of the products passes to you.

 8. DATA PROTECTION & SECURITY

8.1 We comply with all data protection laws applicable to United Kingdom businesses. No customer information will be knowingly given to third parties unless it is required to process your order. Please see the Privacy and Security section on the website for further information.

 9. WARRANTY 

9.1 All products supplied are subject to the manufacturer's guarantees. With the statutory minimum guarantee of 12 months. Please note that all warranties only cover domestic use, all products being correctly installed and products not being subject to misuse.

 10. GOVERNING LAW

 10.1 English law shall govern all contracts formed between us for the purchase of items from this Web Site and any dispute shall be subject to the jurisdiction of the English Courts.

10.2 If any provisions of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
